Effective October 5, 2026
These Terms and Conditions (“Terms”) govern your access to and use of shopdearmatcha.com and any related online services operated by Dear Matcha (collectively, the “Site”), including purchases made through the Site. By using the Site or placing an order, you agree to these Terms and our Privacy Policy and Shipping and Returns Policy. If you do not agree, do not use the Site.
Eligibility
You must be at least 18 years old or the age of legal majority where you live to place an order. If you use the Site on behalf of a business, you represent that you have authority to bind that business to these Terms.
Accounts
If customer accounts are enabled, you are responsible for providing accurate information, keeping your credentials confidential, and all activity under your account. Notify us at info@shopdearmatcha.com. if you suspect unauthorized use. We may suspend or close an account when reasonably necessary to protect the Site, users, or Dear Matcha or to address a violation of these Terms.
Products and product information
We try to describe and display products accurately. Natural agricultural products, printed materials, fabrics, colors, packaging, and handmade or small-batch items may vary. Screen settings may also affect how colors appear. Images are illustrative and may not show exact scale.
Product availability, packaging, ingredients, net weight, preparation guidance, and other details may change. The label and information included with the product control if website information conflicts with the physical product, except where law provides otherwise. Contact us before purchase if you have a question about an ingredient, material, fit, or use.
Food and wellness information
Matcha is a food product and naturally contains caffeine. Information on the Site is for general educational purposes and is not medical advice. Dear Matcha does not diagnose, treat, cure, or prevent any disease or condition. Consult a qualified health professional if you are pregnant, nursing, sensitive to caffeine, taking medication, managing a health condition, or unsure whether a product is appropriate for you.
Orders
Your order is an offer to purchase. We may accept, decline, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, pricing or description errors, payment issues, shipping restrictions, or quantity limits. An automated order confirmation acknowledges receipt but does not necessarily mean the order has been finally accepted.
If we cancel a paid order, we will refund the amount charged for the canceled portion to the original payment method. We may limit quantities per person, household, account, payment method, or order.
Prices, taxes, and payment
Prices are shown in U.S. dollars unless stated otherwise and may change without notice. Applicable shipping charges, taxes, and other fees will be shown at or before checkout. You authorize us and our payment providers to charge the payment method you submit for the full amount of your order.
If a price or offer is listed incorrectly, we may correct the error and cancel or contact you about the affected order. We will not charge a higher corrected price without your agreement.
Promotions and gift cards
Promotional codes, discounts, giveaways, and gift cards may be subject to additional terms. Unless we state otherwise, promotions cannot be combined, have no cash value, and may be modified or ended as permitted by law. Gift cards are governed by the terms presented at purchase and applicable law.
Shipping, returns, and refunds
Our Shipping and Returns Policy is incorporated into these Terms. Delivery dates are estimates unless we expressly state otherwise. Title and risk of loss pass as provided by applicable law. Nothing in these Terms limits rights that cannot lawfully be waived.
Wholesale, events, and collaborations
A business, wholesale, event, catering, or collaboration inquiry does not create a contract or guarantee availability, pricing, territory, samples, services, or a response. Any commercial relationship is subject to a separate written agreement or written order confirmation from Dear Matcha.
Intellectual property
The Site and its content, including the Dear Matcha name, wordmark, bird artwork, packaging, photographs, graphics, videos, text, layout, and other materials, are owned by Dear Matcha or used with permission and are protected by intellectual-property laws. Except for personal, non-commercial use of the Site, you may not copy, reproduce, modify, distribute, sell, license, publish, display, create derivative works from, or commercially exploit Site content without prior written permission.

You retain ownership of your content, but you grant Dear Matcha a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, display, and distribute that content for operating, improving, and promoting Dear Matcha, subject to applicable law and our Privacy Policy.

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. Dear Matcha disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except for warranties that cannot be excluded under applicable law. Product-specific warranties, if any, will be stated with the product.

These limitations do not apply where prohibited, including to liability that cannot legally be limited or excluded.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Dear Matcha and its owners, officers, employees, contractors, and agents harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Site, your violation of these Terms, or content you submit that violates another person’s rights. This section does not apply to the extent a claim results from Dear Matcha’s own unlawful conduct.
Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Subject to any rights you have under applicable consumer law, any court proceeding arising from these Terms or the Site must be brought in a state or federal court located in Montgomery County, Maryland, and each party consents to that court’s jurisdiction and venue.
Before filing a claim, you and Dear Matcha agree to make a good-faith effort to resolve the issue informally. Send a written description of the issue and requested resolution to info@shopdearmatcha.com. This informal process does not prevent either party from seeking urgent relief or using a small-claims court with proper jurisdiction.
Changes to these Terms
We may update these Terms from time to time. The revised version will be posted on this page with a new effective date. Changes apply prospectively unless law requires otherwise. Your continued use of the Site after the updated Terms take effect means you accept them.
General terms
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a reorganization, financing, merger, acquisition, sale of assets, or similar transaction. These Terms, together with policies incorporated by reference and any applicable order or written agreement, form the entire agreement about the subject matter they cover.
